These Terms and Conditions of Use (the “Terms of Use”) apply to www.saireflections.org, and all associated sites linked to it, its subsidiaries and affiliates. The Site is the property of Sri Sathya Sai Sadhana Trust-Publications Division and its licensors. 

Sri Sathya Sai Sadhana Trust-Publications Division reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms of Use, at any time. It is your responsibility to check these Terms of Use periodically for changes. Your continued use of the Site following the posting of changes will mean that you accept and agree to the changes.

Payment Gateway

  • You agree, understand and confirm that the credit card details provided by you for availing of services our site  will be correct and accurate and you shall not use the credit/debit   card which is not lawfully owned by you.

  • In a credit card transaction, you must use your own credit card. SSSST-PD will not be liable for any credit card fraud. The entire liability as a result of use  of  a card fraudulently will be on the user and the onus to 'prove otherwise' shall be exclusively on the user.

  • We as a merchant shall be under no liability whatsoever in respect of any loss or damage arising directly or indirectly out of the decline of authorization for any Transaction, on Account of the Cardholder having exceeded the preset limit  mutually agreed by us with our acquiring bank  from time to time.
  • User further agrees and undertakes responsibility to provide the correct and valid credit/debit card details on the site.
  • Further the said information will be not be utilized and shared by SSSST-PD   with any of the third parties unless required by Payment  Gateway service providers or  if  it is  required   by law, regulation or  court order.

Definitions

"Agreement" means the terms and conditions as detailed herein including all schedules, appendices, annexure, Privacy Policy, and will include the references to this Agreement as amended, renovated, supplemented, varied or replaced from time to time."
“Our  site”  / “Website”  means the online shopping site www.saireflections.org owned and operated by SSSST-PD, which provides a venue to the users to buy the products listed on www.saireflections.org
"Customer" / "Buyer" /”user”  shall mean the person or any legal entity who accepts the offer made  by SSSST-PD  by placing an order for and/or purchases of any products offered by SSSST-PD  on www.saireflections.org  [The User certifies that he/she is at least 18 (eighteen) years of age or has the consent of a parent or legal guardian if  he/ she  is  between 13 and  18.

 

Products and Services and delivery:

  • SSSST-PD  is  committed  to  Product  quality and Prompt  delivery.  SSSST-PD shall  either deliver or  make the  product  available  for  download  as  described  on the  website  . Delivery / availability of   products / items will be of the same quantity and same qualities as are specified on our website.  Such products shall correspond with the description of the items listed on the site.

  • In case of Product damaged in transit or if the packaging is tampered with or damaged before delivery, please refuse to accept the package. Call our customer care at  +91-8555-287375 between 0930 – 1800 IST time or email us photosadmin@saireflections.org  mentioning your Order ID. We will look  into the  matter and  ensure that a replacement delivery is rushed to you at the earliest.

  • After  receiving the  delivery and  opening the  package  , In case  of  wrong  product  or  damage  product /s , please inform  us via  above mentioned email / phone   so  that we shall look in to the  matter and  resolve the  issue  in a most  amicable  way.

  • SSSST-PD may make changes to any products or services offered on the Site, or to the applicable prices for any such products or services, at any time, without notice. The materials on the Site with  information related  to products and services may be out of date, and SSSST-PD makes no commitment to update the materials related  information on the Site with respect to such products and services.

Buyer  obligation other  than payments done while placing the  order

  • The address at which delivery of the product ordered by buyer  are to be made should be correct , proper and  complete  in all respects. After the completion of  transaction SSSST-PD shall arrange for the delivery of the product to the buyer at the shipping address provided by the Buyer.

  • In the  event that a non-delivery occurs on account of a mistake by you (i.e. wrong name or address or any other wrong information entered  by buyer) any extra cost incurred by SSSST-PD  for redelivery shall be claimed from Buyer. SSSST-PD reserves  right  to  re  deliver  the  ordered items  on receipt  of  required  additional  amount from the   customer   in such  cases.

  • Any / all orders placed by you on this Site are a firm commitment to purchase and you are obligated to complete the transaction and not contest it in anyway.

  • Before placing an order you are advised to check the product description carefully. By placing an order for a product you agree to be bound by  terms  the conditions of sale  mentioned  here  and  in the item's description.

  • Photos and other  products  offered by us  are  sacred and should  be  treated  as  Divine  Gift  or  Prasadam. The User agrees to use the products  and  services provided by SSSST-PD  for  personal  and  lawful purposes and  for  societal  well being only.

  • Any additional Costs /expenses over and  above the  payments  done  at the time  of placing  the  order  like import  / octroi / customs duties  and  any other  levies  will be  borne  by the  user and  user  will  make   own arrangements  to  take  delivery  in case  the  parcel  is held up  with concerned  authorities  for  want of  such  charges / levies  or  any other  non  monetary  reasons. SSSST-PD’s  role will be  only to  furnish  the details of  the Shipper  and clarifications information furnished  by such shipper if  any  regarding  the  cause  for the delay and  hold up  of  the  consignment.

  • In  case of return of entire or part of the  consignment  buy Customs  or  by other  such  authorities .

  • In case of  return of  items  by customs or  other  authorities or  duties  . other  charges claimed by them will be  informed  to  the buyer  by email  / Post and  buyer will make  his/her arrangements  to  clear  up  such  goods  held  and take  the  delivery.

Cancellation of Orders:


Buyer  cannot  cancel  an order  once placed  on the  website. SSSST-PD in some  exceptional  cases like  wrong entry of  quantity etc   may entertain the  cancellation  request  sent  by the  buyer and  credit  the  amount  in the  personal  ledger  account  of  such  buyer. Same  amount  can later  be  utilized  for  other  products  and  services  offered by SSSST-PD. However  such  cancellation  and  reversals  will be  sole  discretion of SSSST-PD.
Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any such reasons. Some situations that may result in your order being cancelled include limitations on quantities available for purchase, inaccuracies or errors in product or pricing information, or problems identified by our credit and fraud avoidance department of Payment  gateway  Services Providers.  We may also require additional verifications or information before accepting certain orders. We will contact you if all or any portion of your order is cancelled or if additional information is required to accept your order. If your order is cancelled after your credit card has been charged ,  the said amount will be refunded back  by us  by instruction to   our Payment  Gateway Service providers  in the  same  way  the  amount  was  credited  to  us.

Site  Content and  Usage

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code (collectively, “Content”), including but not limited to the design, structure, selection, coordination, expression, “look and feel” and arrangement of such Content, contained on the Site is owned, controlled or licensed by or to Sri Sathya Sai Sadhana Trust-Publications Division, and is protected by copyright, patent and trademark laws, and various other intellectual property rights and unfair competition laws.
Except as expressly provided in these Terms of Use, no part of the Site and no Content may be copied, reproduced,downloaded, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Web site or other medium for publication or distribution or for any commercial enterprise, without Sri Sathya Sai Sadhana Trust-Publications Division’s express prior written consent. 
You may use information on SSSST-PD products and services purposely made available by SSSST-PD for downloading from the Site, provided that you

(1) do  not remove any proprietary notice, language text  in all copies of such documents,(2) use such information only for your personal, non-commercial , informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) not make any additional representations or warranties relating to such documents. 
You may not use any “deep-link”, “page-scrape”, “robot”, “spider” or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Site or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Site or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Site. SSSST-PD reserves the right to bar any such activity.
You may not attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any SSSST-PD server, or to any of the services offered on or through the Site, by hacking, password “mining” or any other illegitimate means.
You may not probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach the security or authentication measures on the Site or any network connected to the Site. You may not reverse look-up, trace or seek to trace any information on any other user of or visitor to the Site, or any other customer of Sri Sathya Sai Sadhana Trust-Publications Division, including any SSSST-PD account not owned by you, to its source, or exploit the Site or any service or information made available or offered by or through the Site, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than your own information, as provided for by the Site.
You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Site or Sri Sathya Sai Sadhana Trust-Publications Division’s systems or networks, or any systems or networks connected to the Site or to Sri Sathya Sai Sadhana Trust-Publications Division.

Accounts, Passwords and Security

Certain features or services offered on or through the Site may require you to open an account (including setting up an user ID and password). You are entirely responsible for maintaining the confidentiality of the information you hold for your account, including your password, and for any and all activity that occurs under your account as a result of your failing to keep this information secure and confidential. You agree to notify SSSST-PD immediately of any unauthorized use of your account or password, or any other breach of security. You may be held liable for losses incurred by SSSST-PD or any other user of or visitor to the Site due to someone else using your user  ID, password or account as a result of your failing to keep your account information secure and confidential.
You may not use anyone else’s user  ID, password or account at any time without the express permission and consent of the holder of that user  ID, password or account. SSSST-PD cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

Privacy

Sri Sathya Sai Sadhana Trust-Publications Division’s Privacy Policy applies to use of this Site, and its terms are made a part of these Terms of Use by this reference. Additionally, by using the Site, you acknowledge and agree that Internet transmissions are never completely private or secure. User  should  understand that any message or information you send to the Site may be read or intercepted by others, even if there is a special notice that a particular transmission is encrypted.

Disclaimer  and  Limitation of Liability

  • Except where prohibited by law, in no event will SSSST-PD be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if SSSST-PD has been advised of the possibility of such damages.
  • If, notwithstanding the other provisions of these Terms of Use, SSSST-PD is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Site or any Content, Sri Sathya Sai Sadhana Trust-Publications Division’s liability shall in no event exceed the price of the products/services purchased on the  website. Some jurisdictions do not allow limitations of liability, so the foregoing limitation may not apply to you if you fall  in such jurisdiction.
  • SSSST-PD shall not be liable for any delay due to flood, fire, wars, acts of God or any cause that is beyond the control of  SSSST-PD.
  • SSSST-PD  will not be responsible for any damage suffered by users from use of the services on this site. This includes loss of revenue/data resulting from delays, non-deliveries, missed deliveries, or service interruptions / malfunction  or  willful  default  of Payment  gateway  services  provider  etc   as may occur. This disclaimer of liability also applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence, or under any other cause of action.

Indemnity

User  agrees to indemnify and hold SSSST-PD, its Trustees / other  Staff / employees, affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys’ fees), made against SSSST-PD by any third party due to or arising out of or in connection with usage  of this  site and the links  provided  on this  site   to  other sites.

Information Disclosure Policy

SSSST-PD may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of the Site, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) Sri Sathya Sai Sadhana Trust-Publications Division’s rights or property, or the rights or property of visitors to or users of the Site, including Sri Sathya Sai Sadhana Trust-Publications Division’s customers. SSSST-PD reserves the right at all times to disclose any information that SSSST-PD deems necessary to comply with any applicable law, regulation, legal process or governmental request. SSSST-PD also may disclose your information when SSSST-PD determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for the purposes of  protection against  fraud. 
You acknowledge and agree that SSSST-PD may preserve any transmittal or communication by you with SSSST-PD through the Site or any service offered on or through the Site, and may also disclose such data if required to do so by law or SSSST-PD determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of Sri Sathya Sai Sadhana Trust-Publications Division, its staff ,employees, users of or visitors to the Site, and the public. 

Violation of Terms of Use

You agree that SSSST-PD may, in its sole discretion and without prior notice, terminate your access to the Site and/or block your future access to the Site if 
i)we determine that you have violated these Terms of Use or other agreements or guidelines which may be associated with your use of the Site. You also agree that any violation by you of these Terms of Use will constitute an unlawful and unfair business practice, and will cause irreparable harm to Sri Sathya Sai Sadhana Trust-Publications Division, for which monetary damages would be inadequate, and you consent to SSSST-PD obtaining any injunctive or equitable relief that SSSST-PD deems necessary or appropriate in such circumstances. These remedies are in addition to any other remedies SSSST-PD may have at law or in equity. 
ii)requests by law enforcement or other government agencies, 
iii) a request by you (self-initiated account deletions),
iv) discontinuance or material modification of the Site or any service offered on or through the Site, or
v) unexpected technical issues or problems. 
If SSSST-PD does take any legal action against you as a result of your violation of these Terms of Use, SSSST-PD will be entitled to recover from you, and you agree to pay, all reasonable attorneys’ fees and costs of such action, in addition to any other relief granted to Sri Sathya Sai Sadhana Trust-Publications Division. You agree that SSSST-PD will not be liable to you or to any third party for termination of your access to the Site as a result of any violation of these Terms of Use.

Governing Law; Dispute Resolution

You agree that all matters relating to your access to or use of the Site, including all disputes, will be governed by the laws of India without regard to its conflicts of laws provisions. Any claim under these Terms of Use must be brought within 90 (Ninety) days after the cause of action arises, or such claim or cause of action is barred. In the event of any controversy or dispute between SSSST-PD and you arising out of or in connection with your use of the Site, the parties shall attempt, promptly and in good faith, to resolve any such dispute within a reasonable time. 
This agreement shall be construed in accordance with the applicable laws of India. The Courts at Bangalore  -Karnataka State  - India  shall have exclusive jurisdiction in any proceedings arising out of this agreement.

Feedback and Information

Any feedback you provide at this site shall be deemed to be non-confidential if it is in the  interest  of larger  masses. SSSST-PD shall be free to use such information on an unrestricted basis.
